Residency Permits

Residency Permits in Panama

Visas are authorizations that allow foreigners to enter or stay in Panama as non-residents. These include:

  • Consular visa (for certain nationalities).
  • Short-stay visas, temporary work visas, and visas for domestic workers.

Temporary Residencies in Panama are linked to work or business. These residencies are granted for one year and can be renewed for up to six years.

Permanent Residencies are granted to foreigners who wish to reside permanently in Panama. Some conditions include:

  • Marriage to a Panamanian or having Panamanian children over 5 years old.
  • Investments in Panama (reforestation, businesses, real estate, fixed-term deposit).
  • Retirees or pensioners with a minimum monthly pension of $1,000.

Work Permits

Work Permits in Panama
  • Work Permit Type 1 A: migrant worker with ten (10) or more years of residency in Panama (Indefinite).
  • Work Permit Type 1 B-1: migrant worker with a Panamanian spouse.
  • Work Permit Type 1 B-2: migrant worker with children of a Panamanian spouse with custody of a minor in case of divorce.
  • Work Permit Type 1 C: migrant worker with special permanent residency, granted by the President of the Republic.
  • Work Permit Type 1 D: migrant worker as the parent of a Panamanian citizen in a dependent condition.
  • Work Permit Type 1 E: migrant worker under the Treaty of Friendship, Commerce, and Navigation between the Republic of Panama and the Republic of Italy.
  • Work Permit Type 2 A: migrant person hired by an employer as ordinary personnel within 10% of the total workforce.
  • Work Permit Type 2 B: migrant worker hired by an employer as a specialist or technician within 15% of the total workforce.
  • Work Permit Type 2 C: foreign person hired as trusted personnel by an employer.
  • Work Permit Type 3 A: migrant worker hired as an executive by an employer in the Colon Free Zone.
  • Work Permit Type 3 B: migrant worker hired by an authorized employer within the City of Knowledge Foundation regime.
  • Work Permit Type 3 C: migrant worker hired by an employer within the Panama Pacifico Area.

Business Registration

Creation of a Corporation or Limited Liability Company (LLC)

Panamanian corporations, as well as limited liability companies, are a secure means through which you can organize and operate your business, plan property purchases, and open bank accounts, inside or outside Panamanian territory.

Advantages of a Corporation:
  • It limits your legal liability to the assets of the company, not extending to your personal assets.
  • All contracts, including labor ones, are signed in the name of the company.
  • Fiscally, you are not personally responsible, but the company is.
  • In case of selling the business, you can sell the shares.
Registration with the Tax Authority

Bufete Illueca processes the Single Taxpayer Registry (RUC), through which the General Directorate of Revenue (DGI) grants the tax identification to the company.

Every company, regardless of whether it operates as an offshore (without operations in Panama), must have its RUC.

Commercial Permits

Commercial Permits in Panama

Every company wishing to conduct business in Panama must obtain a Notice of Operation (commercial license). This license details the physical location of the business and clearly specifies the activity to be carried out.

This process notifies the commercial, tax, and municipal authorities of the start of business operations in Panama. Once the notice of operations is obtained, the company can begin billing.

Depending on the type of business, special licenses must be processed before other government entities; for example, those related to the sale of medicines, alcoholic beverages, and agricultural products.

Registration with the Municipality

The company must register with the Municipality where it is physically located, as it will be subject to municipal taxes depending on its commercial activity.

Minimum Requirements for Opening a Bank Account
  • Articles of Incorporation (Constitutive Document) and its amendments.
  • Board of Directors Minutes signed by the secretary and president authorizing the opening of the account, and indicating the names of the signatories.
  • Copies of ID and second identification of dignitaries and signatories.
  • Bank or commercial reference letters of the company.
  • Foreign individuals must present two updated bank reference letters and passport.
  • Good credit references.

Taxes in Panama
Annual Fixed Payment for Corporations (Single Rate)

Article 318-A of the Panamanian Tax Code establishes that all corporations will pay a fixed annual rate of $300.00 US dollars, in each fiscal period, regardless of whether the corporation is active or not, nor the type of activity it performs or the amount of its declared capital.

Only those income derived from activities carried out within or from the Republic of Panama will be subject to income taxes. The income tax for corporations is 25% on the company's income after subtracting costs and deductions.

Dividends that come from Panamanian source activities apply a tax rate of 10% on nominative shares and 20% on bearer shares.

Article 1057-V of the Tax Code sets at 7% the tax on the transfer of movable goods and services. This tax must be registered and collected based on the invoices that a company issues.

The social security tax is 9.5% for workers and 12% for employers. It taxes gross salary, in-kind salary, and representation expenses.
